Judge Halprin denies my right to a motion.
Once Deidre Waters’s lawyer filed a motion to recoup the legal fees, I thought I had a right to speak in court why the motion should be denied. I spoke to some lawyers and they all said, yes all judges will let you state why you think the motion should be denied, and it is the law. Apparently Judge Halprin, feels I cannot state my reason to deny her motions. Judge Halprin stated I have no right to block her motion and the trial will go on, to see if I have to pay for my own eviction. I said, don’t I have a right to state my reason why her motion should be denied and he said NO. In addition, he said “the question is how much of her lawyer’s fees I have to pay.” Apparently, he already has made up his mind that I do have to pay her lawyers fees. I was under the impression, and so were all the lawyers I spoke to, that the trial first will determine if I have to pay and only then how much. In addition, he stated that it is common for landlord to sue and get back there legal fees from the tenant if evicted. In New York City that is almost never the case, I know this since I was a real estate manger for 15+ years. I also spoke to a real estate management company that managers over 5,000 units and they said in 10+ they have never recouped their legal fees in an eviction case. Judge Halprin simply lied (I guess that is way he like Deidre Waters)
Judge Halprin, is either on something or worse, a very corrupt judge who can be bought for a few dollars. I say this because of his actions that defy logic and the law. I will in the next few days lodge a formal compliant against Judge Halprin and his action. For example, Juge Halprin put an armed guard next to me for no apparent reason other than to intimidate me and my lawyer not to speak up and challenge his absurd rulings.
The trial it set for December 20, however it is not really a trial, since Judge Halprin has already made up his mind and has decided the outcome. He stated that clearly on November 29, 2005.

WHAT GOES AROUND COMES AROUND!
Prior to this I have never met or heard about Seymour Friedman. But it appears Seymour Friedman has obviously tried to use the court system many times to his advantage by suing his landlord over and over again in housing court for rent reductions (on an apartment that by his own admission is way below market). I guess the legal system goty him back now. What goes around comes around!!!
(what is shocking to me is that any landlord rented an apartment to this guy, considering his litigious history
yes I have used the legal system to get the landlord to fix a very bad leak in my kitchen ceiling and to get the landlord to supply heat which the building did not have on many occasions for a few days. There was so much water coming down that one night a 3 foot by 6 foot piece of the ceiling came crashing down luckily neither I or my dogs where in the kitchen or we could have been badly hurt. I gave the landlord a few month to fix the ceiling to no avail and only then did I use the court system to get the landlord to fix some major repairs.
I never sued for rent reduction I went to court to have my apartment repaired. The judge granted the temporary rent reduction for the time the kitchen was not usable. Interestingly, I lived in that apartment for over 15 with two previous landlord with no issues, no court cases nothing, we got along. Only when this landlord Central Park Realty took over the building 3-4 years ago did the trouble start.
I do have a question for jonathan. What would you have done after waiting for months the have a leak fixed. A leak that caused the ceiling to collapse. A leak so bad that everyday I had to mop the floor a few times a day.
